Hearing on Centre's petition against Madras High Court's comment on 10 per cent quota notification to be held

New Delhi: The Supreme Court will tomorrow hear an application filed against the Madras High Court's observation that the notification allocating 10 per cent quota in the All India quota of medical colleges to economically weaker class (EWS) students requires Supreme Court approval.

The Madras High Court on August 25 had allowed the Centre's July 29 notification to give 27 per cent reservation to OBCs for admission in central medical colleges under the All India quota.

However, the High Court said that the notification of the Central Government to keep a separate 10 per cent reserve quota for the Economic Weaker Section needs the approval of the Supreme Court. The notification of the Central Government cannot be validated without the approval of the Supreme Court.

Following the Madras High Court's review, the Center had filed an application in the Supreme Court on September 3 against the review. A bench comprising Justice DY Chandrachud and Justice B V Nagaratna will hear the Centre's plea tomorrow.
