Convicting a real estate company of disobeying a court order, the Supreme Court said the builder only understands the color of the money or the jail sentence. At the same time, the court has imposed a fine of Rs 15 lakh on Erio Grace Realtech Pvt Ltd for knowingly disobeying its order.
The apex court has ordered the real estate company to deposit Rs 15 lakh with the National Legal Services Authority. Apart from this, home buyers have also been asked to pay Rs 2 lakh as legal expenses. Home buyers did not receive their refunds as ordered by the court.
A bench comprising Justice DY Chandrachud and Justice MR Shah said, "We upheld the NCDRC's order dated January 5 to pay the amount with 5 per cent interest." We asked you to pay the amount in two months. At that time you filed an application and demanded to amend the order. We rejected the application in March and asked the home buyers to pay the amount within two months. Yet you have not yet paid the amount. Which means we have to hit big fines or send someone to jail. The builder understands the color of money or a prison sentence.
