How can news based on a police report be defamatory?

Mumbai: A defamation suit filed by actress Shilpa Shetty alleging that false and defamatory news was being published by the media was heard in the Bombay High Court. The High Court has directed to remove the offensive videos and some of the offensive statements made by Uttar Pradesh's Capital TV from the website.

However, the court did not issue any interim order regarding media coverage. While reporting on a porn film chapter involving Raj Kundra, his image is being tarnished by giving untrue news. Shilpa had requested the media to refrain from reporting on the matter and order the concerned media outlets to pay compensation.

Shilpa's lawyer claimed that having small children affects the whole family. The advocate on behalf of Shilpa said that the reporting of some media houses in the Raj Kundra chapter was not based on facts and an attempt was made to harm Shilpa's image by casting unnecessary votes. Some have also questioned Shilpa's motherhood and the upbringing of young children.

Heena Kumawat of Capitol TV and Film Window was observed by the court as prima facie defamatory of the famous video and directed the relatives. Heena Kumawat, the founder of Film Window, was assured that she would not upload the video of the statement made about Shilpa as it was taken from the internet.

Intervening in this, the petitioner also sought permission to make some changes in the application which was accepted by the court. The court directed the defendants to file an affidavit by August 18 and reply to Shilpa by August 26. The next hearing in the case is set for September 20.
