The answer to this question is that even after losing the election, Mamata Banerjee will be the new Chief Minister of West Bengal. Under Article 164 of the Indian Constitution, he can be sworn in as Chief Minister. Article 164 (4) states that a minister who has not been a member of the State Legislature for six consecutive months must resign. Which means Mamata Banerjee will have to win elections from any assembly seat within six months.
