Nirbhaya Case: Vinay Sharma's Supreme Curator Petition Announces Death Warrant


Two executioners will be hanged for Nirbhaya criminals

Vinay Sharma, one of the four criminals, has filed a curative petition in the Supreme Court just days after the Delhi Patiala court issued a death warrant in the Nirbhaya case. The petition also demanded a stay on the hanging on January 22.

As such, the case is once again suspected to be confused with the law. However, it is still the tradition of the Supreme Court that it has reversed its judgment in the Curative Petition by the apex court only in the case of the Rare of Rare case. The execution of the convicts was fixed on 22 May.

Curative petition is the ultimate solution for Nirbhaya criminals. Delhi Patiala court on January 7 issued death warrants to all the four criminals Mukesh (32), Pawan Gupta (25), Vinay Sharma (26) and Akshay Kumar Singh (31) in the Nirbhaya case.

All four criminals will be hanged together at Tihar Jail No.3 on January 22 at 7.00 am. For this, consent has been given from Uttar Pradesh Prison Department to send the executioner to Tihar Jail. Tihar Jail has sought two executioners from Uttar Pradesh.

In his curative petition, Vinay stated that his adolescent argument was rejected. The petitioner contended that the applicant's socio-economic circumstances, including his parents and his dependent members of the family, did not consider good behavior in the jail.

The petition further stated that factors such as 'social pressure' and 'public opinion' played a more important role in the court's verdict against him and others. However, according to some experts, the culprit's curative petition is very unlikely to be approved.

The Supreme Court reverses its ruling on a curative petition only in the case of a case of rarest of cases. In addition to the curative petition, the option for criminals to appeal to the President is open. Akshay Thakur, one of the perpetrators of the case, rejected the review petition filed by the Supreme Court earlier.

While dismissing the review petition, the Supreme Court said that the lawyer of the accused was given full opportunity in this case, but he was not saying anything new. Meanwhile, Tihar jail authorities have begun preparations to hang all four criminals of Nirbhaya massacre. It is believed that one executioner will be the wind of Meerut to hang the guilty, while another is yet to be decided.
