New Delhi: Strongly criticizing the Uttar Pradesh government's Special Investigation Team (SIT) investigating the Lakhimpur-Kheri riots, the apex court has issued a stern order to remove the impression that it is being manipulated in the case. He also slammed the snail's pace of proceedings in the case. The SIT has also been directed to take the statements of more and more witnesses before the magistrate under section 12 of the Crpc to present a solid case.

It is a well-known fact that a total of nine people, including farmers, were killed in the October 2 riots in Lakhimpur-Kheri village in Uttar Pradesh.

The apex court had sought a 'status-report' on the incident. Which was introduced by the Government of Uttar Pradesh. After that, the Chief Justice of the Supreme Court, Shri N.V. A bench comprising Ramanna and Justices Shri Suryakant and Ms. Hima Patel visited U.P. Representing the government, advocate Harish Salve was again asked how many arrests have been made in the case. How many have been sent to police / judicial custody? And how many witness statements have been recorded before the magistrate under section 12 of the Crpc.

"So far, 10 accused have been arrested and the statements of 20 witnesses have been taken before the police while the statements of nine have been taken before a magistrate," Salve told the court. Four of the accused have been taken into police custody.

At this stage, the bench asked, "Why other accused have not been taken into police custody?" Salve said he had previously been taken into police custody and after questioning, his statements were recorded and he was sent to judicial custody.

In this regard, the court said, "The statements recorded under section 16 are considered different types. Its authenticity is much higher. Your SIT will know right away which witnesses can be easily suppressed. And which witness is the one who breaks down the fastest. Why, then, are the statements of only four witnesses taken? "The process is ongoing," Salve said. Which has been delayed due to Dussehra festivals.

After this, the Supreme Court ruled in favor of U.P. The government was ordered to submit an updated status report and a further hearing was scheduled for. Held on 9th October.

In fact the Supreme Court already looked annoyed as the status report itself was released too late. "I used to stay up till 1 am for the status report," the chief justice told Salve. Moreover, the report did not have to be given in a sealed cover. He also said that such reports should be received at least four hours in advance, while Salve said that now another report would be released on Monday (the next day).

The apex court had also ordered to separate the cases of SUVs and leaching of BJP workers from farmers.
