Important judgment of the Consumer Commission in favor of the aggrieved consumer

New Delhi: A 45-year-old model of a hair product living in Gurugram has been fined Rs. The National Consumer Commission has ordered compensation of Rs 2 crore.

The commission termed the act of cutting defective hair in a manner that would cause mental anguish and endanger one's career as negligence of the salon. A two-judge bench noted that women are especially careful about their hair. They spend a lot of money on grooming and caring for their hair. They are also emotional about their hair.

The bench further noted that the plaintiff Ashna Roy was modeling for hair products and had done modeling work for several brands. But he lost his assignments due to cutting his hair contrary to his instructions which caused him a lot of damage.

The Consumer Commission has also held the hotel responsible for medical negligence in hair treatment. The order stated that the model's palate was burnt due to the negligence of the hotel staff and that she was still suffering from allergies and inflammation.

The model visited ITC Maurya's salon for hair grooming and styling in April 2018 to prepare for an interview. Since her regular hairdresser was not present that day, another hairdresser was assigned the job. Roy clearly instructed the hairdresser to keep a long braid on his face and back as well as trim 4 inches of hair from the ends.

Investigations revealed that Roy had glasses and was told to keep his head down during the entire hair cutting process. As a result it did not appear in the glass. Roy was told he was being given a 'London haircut'. But Roy was shocked when he looked in the glass. According to her the hair dresser cut all her hair leaving 4 inches contrary to her instructions.
