Madras High Court quashes April 6, 2018 notification and orders state-central government to issue new speed limit notification

Chennai: The Madras High Court has quashed a central government's announcement setting a speed limit of 120 kmph for vehicles plying on the highway. Justice Sarvashri N. Kirubakaran and TV. The Tamil Nadu Selvi Division Bench quashed the notification issued by the Central Government on April 6, 2018.

The bench also directed the Center and the state government to issue a new notification reducing the speed. The original case was that a dentist was seriously injured in a road accident in Kanchipuram, Tamil Nadu in 2013, leaving him with 90 per cent disability.

The dentist later filed a case for compensation in the court in which the court ruled in favor of the petitioner on March 3 this year, awarding Rs. 18.43 lakh to Rs. 1.50 crore.

The High Court also directed the Central Government to cancel its notification in 2018 and issue a new one to reduce the speed of vehicles.

The Center was to submit a report last August detailing the extent to which the Center has complied with its order and other conditions.
