The Allahabad High Court on Saturday handed down a landmark judgment in the kidnapping, conspiracy and proselytizing case. The court also dismissed the accused's bail application. During the hearing, the court said that every citizen has the right to adopt any religion. There is a constitutional right to marry of one's own free will.

Javed alias Javed Ansari is accused of kidnapping, conspiracy and conversion. Not only that, Javed has also been accused of converting to Islam by speaking falsely against his will. Javed had knocked on the door of the high court seeking bail in the case but the court rejected his bail application.

Signed on paper written in Urdu: Alleged victim

In this case, the victim has given a statement to the magistrate that Javed signed the paper written in plain and Urdu. Not only that, Javed also hid the fact that he was married to Pagle and he converted by lying. Not only that, the victim alleged that when she went to Jalesar Bazaar on November 17, 2020 at 5:00 pm, some people forcibly put her in a car and the next day when she came to her senses, she was in the courtroom amidst a crowd of lawyers. There he had papers signed and was converted on November 18th. The marriage took place on 28 November.

We are both adults, married voluntarily: accused

"Both are adults and have voluntarily changed their religion and got married," Javed told the court. Also the religion was changed long before the conversion law came into force.

The court struck down

The case was heard in a single bench of Justice Shekhar Kumar Yadav. Meanwhile, Justice Yadav said that the Constitution gives everyone the right to live with dignity. People are leaving home for honor, changing religion for humiliation, contractors of religion should improve themselves because changing the religion of many people weakens the country.

"Disruptive forces benefit from this, history has shown that we were divided, the country was invaded and we became slaves," the court said. The Supreme Court has also considered religion as a way of life. Justice Yadav said that faith and trust cannot be bound, there is no place for bigotry, fear and greed. The court said that marriage is a sacred rite, changing religion for marriage cannot be null and void.
