Emerald case verdict: Supreme Court orders demolition of two 40-storey towers of Supertech

New delhi date. Tuesday 31st August 2021

The Supreme Court has ordered the demolition of two 40-storey towers of the Supertech Emerald Court project in Noida. In its judgment, the apex court said that the Supertech Emerald Court in Noida had constructed two towers with 915 flats and 40 storeys with shops in violation of the rules.

The construction has been linked with the Noida Authority. Now Supertech will have to demolish both the gates within two months at its own cost. All flat owners in both towers have been ordered to pay compensation with 12 per cent interest.

The apex court had challenged the Allahabad High Court's order to demolish two 40-storey supertech towers for violating building rules. Which has been rejected by the Supreme Court. In 2014, the Allahabad High Court ordered the demolition of both the towers illegally.

It has 950 flats in 2 towers of 40-40 floors. However, a large number of people have withdrawn their money from the project. People living in the Emerald Court premises alleged that the builder Supertech erected this huge tower in the open area of the society in the greed of money without permission.

On August 4, the Supreme Court reserved its decision on the petitions. Home buyers of Supertech's Emerald Court project were reprimanded for failing to submit a plan approved by the Court Noida Authority that you (the authority) are surrounded by corruption on all sides.

The bench said that when home buyers asked to hand over the scheme, the authority asked the developer whether it should be shared. At the request of the developer, he refused to hand over the plan. Realty firm Supertech Ltd defended the construction of the tower, claiming it was not an illegal act.
