In Delhi, the bill clarifying the powers of Lieutenant Governor i.e. Deputy Governor and Chief Minister has been approved in both the Houses of Parliament. The Rajya Sabha on Wednesday approved the Government of National Capital Territory of Delhi (Amendment) Bill 2021 amid opposition hobbling. The bill was passed in the Lok Sabha on Monday. Now the bill will become law after the President signs it.

Who is the King of Delhi, LG or the Chief Minister? The issue has been hotly debated since Arvind Kejriwal became the Chief Minister. Until the issue even reached the Supreme Court. The Supreme Court clarified the roles and jurisdiction of LG and the Delhi government through its judgments in 2018 and 2019. Now the central government is arguing that it has amended the Government of National Capital Territory of Delhi Act to implement the spirit of the Supreme Court order. LG's jurisdiction has been widened under the bill, which has already been passed in both houses of parliament. As per the provisions of the bill, the state cabinet or government will seek the opinion of the deputy governor before implementing any decision.

According to the bill, in any law made by the Delhi Legislative Assembly, the government will mean the Deputy Governor. The Deputy Governor must be informed of all decisions, proposals and agendas. If there is a disagreement between LG and the Council of Ministers on an issue, LG can refer the matter to the President.

Not only that, LG will not pass any bill in the legislature that is outside the jurisdiction of the legislature. They will be able to reserve it for the President to consider. The bill limits the rights of elected governments in Delhi. According to the bill, neither the Delhi Legislative Assembly nor any of its committees will make a rule that gives it the right to consider the day-to-day administration activities or investigate any administrative decision. This will act as a shield for officers who are always afraid of getting summons from the Legislature or its committees.

The Supreme Court, in its 2018 judgment, made it clear that it would inform LG of any decision taken by the Delhi government. But LG's consent is not required. But now, under the bill, LG has the power to refer the matter to the president if it does not agree with a cabinet decision.

It is clear that if the bill becomes law, then the powers of the Deputy Governor of Delhi will be greatly increased. However, according to the central government, the bill was brought only to clarify the roles and powers of the deputy governor and the Delhi government so as not to stall. Now that the new NCT bill has been approved by Parliament, the new legal battle of LG vs CM can be seen once again in the national capital.
