If we don't postpone agricultural laws, we will stay: Supreme

If the government had even a little bit of responsibility, these agricultural laws, which were framed without consultation, would have been stopped long ago: Supreme Court

Our hands are not stained with anyone's blood: Supreme

New delhi date. Monday, January 11, 2021

Farmers have been protesting in Delhi for a month and a half demanding repeal of agricultural laws, some of whom have committed suicide on the spot. However, the government is not ready to repeal or stay the law. In the midst of this situation, the Supreme Court has turned a blind eye and made it clear to the Modi government that if you do not put the laws on hold now, we will. The Supreme Court can now rule on the whole matter on Tuesday.

Criticizing the central government for its agricultural legislation, the apex court said that to date, there has not been a single petition or petition in the apex court claiming that it could benefit from agricultural laws. At the same time, the Supreme Court has asked the government what is going on without any result from the talks with the farmers. You have enacted a law without adequate advice from anyone which has resulted in this protest.

Criticizing the government, the court said, "You are in public life. The Indian government must take so much responsibility. If the government had any sense of responsibility, it would have stopped the implementation of the laws for the time being."

A bench of the apex court headed by Chief Justice Arvind Bobade heard various petitions filed on the issue of agricultural law and farmers' protest. The petitions include those of DMK MP Tiruchi Shiva and RJD MP Manoj Zani. These people have questioned the constitutional validity of the agricultural law and demanded its repeal.

"We do not feel that the central government is handling the matter properly. We have to take action today," the apex court said during the hearing. This is a serious matter and we are proposing to set up a committee on it.

We are also considering a moratorium on the implementation of these agricultural laws until further notice. We propose that the implementation of these laws be put on hold for the time being to pave the way for dialogue before the Committee.

Regarding the agitation, the court said that we do not want to say anything more. Protests can continue. But who will take responsibility for it? Whether you believe it or not, the Supreme Court will continue to do its job. We don't mind if you continue to demonstrate or prolong the movement for change.

But we suspect that this could disturb the peace. If anything happens, all of us will be responsible for it. We don't want anyone's blood on our hands. We are the Supreme Court, we will do what we have to do. If the central government does not want to stop the implementation of agricultural laws, we will issue a stay order.

If black laws of agriculture are not repealed, consider my letter as resignation: Abhay Chautala

Opposition to agricultural laws is now intensifying in Haryana as well. INLD MLA Abhay Singh Chautala has written a letter to the Speaker of the Haryana Legislative Assembly demanding repeal of agricultural laws. He also said that if the Central Government does not withdraw these laws, then my letter should be considered as my resignation from the Legislative Assembly. He also termed agricultural laws as black laws and demanded their repeal.

He said that as many as 40 farmers have been killed so far due to cold, suicides but the central government is still insisting on not repealing the laws. On the other hand, a meeting of the Standing Committee on Agriculture was held, though Congress MP Pratap Singh Bajwa, Chhaya Verma and former Akali Dal leader Sukhdev Singh boycotted the meeting as the chairman refused to discuss agricultural laws.

Stay not resolved, laws must be repealed: farmers

The Supreme Court has hinted at a stay on agricultural laws. In the midst of this situation, the agitating farmers are saying that we demand that these laws be repealed forever as it will not benefit us at all. Staying on these laws is not a solution.

"We welcome the Supreme Court's observation," said Gurnam Singh, leader of the farmers 'association and president of the Indian Farmers' Union in Haryana. But a stay on the laws is only a short term. The stay is pending until the court hears the case again. So it is not a compromise or a solution. We want to repeal these laws forever.

Can't put Supreme stay on agricultural laws: Differences among legal experts

The Supreme Court may at any time order a stay on the agricultural laws of the Central Government. In the midst of this situation, Attorney General KK Venugopal has said that the Supreme Court can stay the law only if it seems unconstitutional even at the primary stage.

Senior Advocate Rakesh Dwivedi said that the laws passed by the Parliament cannot be stayed, only if there is a definite and strong reason to stay on the laws, it can only be done if the laws seem unconstitutional at first sight. Lawyer Ashwini Kumar Dubey said the Supreme Court could stay the laws, as the government had earlier stayed the Maratha reserves.

Elderly people sitting on a picket in the cold, women return home: Supreme Court's appeal

The Supreme Court heard petitions on agricultural laws, during which the court expressed concern about the elderly, women involved in the movement. Chief Justice SA Bobde said, "We want the protesting farmers to return to their homes even in the bitter cold. There are many old people, women and children in the movement. Who is taking care of them?" While the arguments were going on, a lawyer HS Fulka said that farmers and women from my village in Punjab have come to the agitation with 50 trolleys. When the court later said that they were sitting in Delhi on a picket in such cold weather, we asked them to return home in view of their health.

Why didn't the government call a joint session for such serious agricultural laws? : Dushyant Dave

* More than 1.5 lakh farmers from more than 200 farmers' organizations have been demanding repeal of the new agriculture law for the last three days. This is a question of the existence of the whole country.

* How can such an important law for the country and the farmers of the country be passed only by voice vote? If the government is really serious about this law then a joint session of Parliament should have been called.

Concerned about the tractor march organized by the central government in Delhi on January 9, the farmers replied that we are not making any statement at present but the farmers will not march in Delhi on the 9th.

* In Punjab, in most of the farmers' families, one member is serving in the Army or the Defense Forces. That is why the protest has been peaceful and there has been no revolt against the government. Farmers are following the law and following the discipline and peacefully presenting their demands, yet the government is not taking note of their problem.

* In the last 3 days, the farmers have fully complied with the law and order as well as discipline and no untoward incident has taken place. For so many days, the farmers have been demanding that they be allowed to sit in the Ramlila Maidan to protest.

* The Supreme Court expressed concern that the elderly, women and children would return as the elderly, women and children also joined the movement amid the cold and epidemic. In reply to which it was said that the issue will be answered in consultation with the farmers' organizations.

* It was recommended by the farmers that the Supreme Court should form a committee on the issue of agricultural law controversy that former Chief Justice of the Supreme Court R.M. Lodha should be appointed to this committee.

* Senior Advocate Dave told the court that he would meet the farmers and discuss the views of the Supreme Court,
