In the case of the Congress-China deal, the CJI said, "How can a party reach an agreement with a government?"

The agreement reached between the Congress party and the Communist Party of China was heard in the Supreme Court on Friday. During the hearing, Chief Justice S.A. Bobade questioned how a political party could compromise with a government. However, prosecutors later clarified that the explanation was between the two parties. Now the Supreme Court has asked to take the case to the High Court.

Amid the dispute with China, there was talk of an agreement between the Congress party and the Chinese Communist Party, and the case has since reached the Supreme Court. During today's hearing, the CJI said some of the issues were legally different and also questioned how a political party could enter into an agreement with China. According to him, to date no agreement has been reached between any government and any other political party.

Lawyer Mahesh Jethmalani said the agreement was with one political party in another country. However, in his reply, the Chief Justice said that you did not mention this in your application. He also said that it gives him an opportunity to change his application and withdraw it.

The Chief Justice then said that you can go to the High Court when the prosecutor said it was a matter of national security and under which UAPA, NIA was a crime. The agreement was reached in 2008 and was between two political parties. In this case, the Bharatiya Janata Party besieged the Congress and accused it of being with China. Political controversy then erupted and the case reached the Supreme Court.
