Important Supreme Court Order: Daughters have equal rights over father's property

The Supreme Court has made an important decision regarding the right of daughters to paternal property. In its order, the court said that according to the amended Hindu Succession Act, daughters have the same right to father's property as sons. A bench of Justice Arun Mishra said that even if the father died before the law came into force, the daughters would get the right to the father's property.

The court said that from September 9, 2005, the daughters would get a share in the property of the Hindu Undivided Family. If the daughters are not alive then their offspring will get this part. The court said that it does not matter whether the daughter is alive or not, the daughters will get their due in every situation.

It may be mentioned that in the year 2005 a law was passed that both son and daughter would get equal share in the father's property. It was not clear whether the law would apply to a family whose father died before 2005. He clarified that no one should be allowed to take this law with the death of his father. Even if the father is not alive on September 9, 2005 Daughters will have a right to property.

This decision is very important for the right to inherit the father's property. Earlier, daughters did not have the right to their father's property. Then in 2005 the court ruled that the daughters were also equal partners in the father's estate. It has now been clarified that even if the father dies before the 2005 verdict, the daughters will get a share in the property.
