President condemns Nirbhaya Pawan Gupta's mercy plea

President Ramnath Kovind has rejected the mercy plea of ​​Nirbhaya gang-rape and murder accused Pawan Gupta.

Pawan Kumar Gupta, one of the four convicts in the Delhi gang-rape case who filed the affidavit in 2012, filed a curative petition on February 28, 2020 in the Supreme Court. In which Pawan Gupta appealed to the court to change his death sentence to life imprisonment. In addition, the trial court has also sought a petition against the black warrant issued for execution. However, the Supreme Court on Monday rejected the petition.

The mercy pleas of three accused Nirbhaya Mukesh Kumar, Akshay Thakur and Vinay Kumar have been earlier rejected. Mukesh also filed a writ petition in the Supreme Court against the cancellation of the mercy petition, which the court has rejected. Pawan has not yet filed a curative petition. After the Supreme Court rejected the curative petition, Pawan Pawan had an option to apply for mercy.

What is a Curative Petition?

The culprit in the curative petition points to the technical aspects of the judgment and questions whether the judgment needs to be amended. But this requires the recommendation of a senior lawyer. A curative petition cannot be filed without the recommendation of a senior lawyer. A curative petition is heard in the chamber. If the Supreme Court rejects the curative petition as well, then a mercy petition may be filed with the President.

1st Death Warrant (January 7): On January 22 at 7 am, the order was executed. The plea of ​​mercy of the accused was pending as the plea was pending.

Second Death Warrant (January 17): On February 1 at 6 o'clock was ordered to be hanged. On January 31, the court avoided hanging indefinitely.

Third Death Warrant (February 17): An order to be hanged at 6am on March 3, the guilty plea said - we still have legal options left.
