Sexual intercourse with a woman by lying is considered rap

Mumbai, Ta. February 28, 2020, Friday

The Bombay High Court has ruled that if a man receives consent (consent) for a woman's body on the basis of the conviction that I do not love you and anyone other than you, the Bombay High Court has ruled that it is not lawful.

The High Court in addition to this landmark judgment also stated that having sexual relations on the basis of such assurances would be considered as rape. In a rap case, a man seeking to declare himself innocent has rejected a man's petition. Sunil Shukre and Justice. Madhav Jamdar gave the verdict.

According to the accused in the case, he had committed adultery with the consent of a woman. There was love between us and he had sex with me voluntarily. He claimed that.

On the other hand, Mahila claimed that because of the wrong promise of the man, I had consented to the body under false pretenses. I was only deceived by the promise that I love you and do not love anyone other than you. The men and women were separated after a short-term relationship.

After considering the facts and arguments of the case, the Division Bench of the High Court came to the conclusion that if the allegations against a man were taken at face value, it would first make the impression that the woman had agreed to have sexual relations with the man on the basis of her trust. The love shown to each other is genuine.

It is also true that the man did not initially promise the marriage to the woman, but it is also true that initially the woman refused the demand for the adultery of the man, saying that no physical relationship could be made before marriage.

'After listening to the woman, the man told her to trap her and said,' I only love you. Judging by the fact that the woman had entrusted herself to him by trusting her words, the judges noted.

The woman had a deep affection for the accused, so he did not have intercourse with her. Instead, it is a case in which a man has tempted a woman to have such a relationship, the judges added.
