Patients should get 14 days after order to reject President's mercy petition: Patiala court

The Tihar jail authorities have written a letter to the Delhi government demanding the avoidance of the execution date and a new date for the death sentence in the Nirbhaya gang rape and murder case.

A hearing on the petition challenging Mukesh's death warrant was held in Patiala House Court on Thursday. On the other hand, the Lieutenant Governor of Delhi has recommended to the Union Home Ministry to reject Mukesh Singh's mercy petition.

All the four criminals in the Nirbhaya case, Mukesh Singh, Vinay Sharma, Akshay Singh and Pawan Gupta, last week announced a death warrant in a seven-year-old case and directed them to be hanged on January 22.

However, one of the convicts, Mukesh Singh, filed a mercy petition before the President and challenged his death warrant in Patiala's court. Hearing in this regard, the Patiala court said that Mukesh Singh, one of the Nirbhaya convicts, has applied for mercy and there are only five days left on January 22.

The President is likely to reject the mercy plea today. Then these people will ask for 14 days. Then ask for a new date. How will it be hanged? The Patiala House Court has asked the Tihar Jail system to file a proper report in this case. There will be a hearing next Friday.

The Tihar Jail system has written to the Delhi government to avoid hanging and give a new date till the mercy petition is resolved. Mukesh's lawyer, Vrinda Grover, on Thursday in Patiala court, said the court canceled the January 22 death warrant. We have appealed to the President and LG of Delhi to be kind.

The Supreme Court dismissed the curative petition at 2.00 pm and we filed a mercy petition at 3 pm. The mercy petition is currently pending before the President. Therefore, the present death sentence cannot be imposed. The Supreme Court verdict also says that at least 14 days should be given to the guilty after deciding to reject the mercy petition of the President.

As such, the current January 22 death warrant should be revoked. After hearing the arguments of both the parties, the Patiala House Court said that the guilty had applied for mercy. We are not currently extending the execution date. We're just asking for a status report from the prison system. The prison system should give the court full information, which has not been provided.

Meanwhile, Lieutenant General of Delhi has requested the Union Home Ministry to reject Mukesh Singh's mercy petition. On Wednesday, the Delhi government rejected Mukesh Singh's mercy plea working at 'lightning speed' and forwarded it to LG. Now LG has requested the Home Ministry to reject the mercy petition.

Nirbhaya convicts shifted to Tihar Jail No.3

Tihar jail authorities have arrested four accused Nirbhaya Mukesh Singh, Vinay Sharma, Akshay Kumar and Pawan Gupta in Tihar Jail in the wake of reports of a full-fledged murder case on January 22. This is the prison in the same prison.

All the four convicts have been kept in an ultra-secure cell in jail No-3. Until recently, Akshay and Mukesh were imprisoned in Tihar Jail No.2. Another convict Pawan Gupta was expelled from Mandoli jail and taken to Tihar Jail No.2 while Vinay Sharma was imprisoned in Jail-4. All convicts have now been shifted to Prison No-3.
