Hard to execute Nirbhaya criminals on 1st February

Prison officials delay providing curative documents: Accused prosecutor accused

New delhi date. January 24, 2020, Friday

A lower court has issued a death warrant for the hanging of Nirbhaya's rapists on February 1st. However, the date could be changed again as the two offenders prepare to file a curative petition in the Supreme Court.

The lawyer for the two offenders filed a petition in the court, claiming that Tihar jail authorities were delaying providing the required documents for the curative petition.

Defendant's lawyer AP Singh made an appeal in the lower court in Delhi on Friday alleging that the jail authorities were delaying providing the required documents for Akshay Kumar and Pawar's curative petition. So the prison administration should be ordered.

The appeal is set to be heard by the court on Saturday. Earlier, the Supreme Court rejected the curative petition of two offenders Vinay Kumar and Mukesh. The Curative Petition Review is the ultimate justification after a petition is rejected. In addition, mercy applications may also be made.

The lower court may ask prison authorities to submit the documents required for a curative petition. If these documents were handed over to the jail authorities by the offender's lawyer, two offenders would later file a curative petition in the Supreme Court. Doing so could delay the execution of criminals on February 1st.

Earlier, on January 22, all four accused were scheduled to be hanged, but they were ordered to be hanged on February 1 after mercy petitions and curatorial petitions were filed. But now the other two criminals are preparing to file a curative petition so the tariff may change again.

The mother of Nirbhaya, on the other hand, is demanding that the offenders be hanged at an early date so that women in the country can be confident and reduce incidents like rape. On the other hand, Nirbhaya perpetrators still have the option of applying for mercy before the President. Therefore, mercy petition can be filed even if the documents required for the curative petition are rejected.
