H1B visa holders' spouses in the US can work: Court

H1B allows non-immigrant visa companies to hire foreign employees

Court refuses to block Obama's administration rule

In a temporary relief to hundreds of thousands of Indians living in the United States, a US court refused to repeal the Haven-B visa holders currently working under the Obama administration. Achavan-B is a non-immigrant visa under which a company can hire specialized business specialists to do its job there.

Under the 2015 rule issued by Trump's predecessor, Barack Obama, H-4 visa holders may get a work permit for a particular category. Especially if their spouse is an H-B work visa holder and they are waiting to get a green cord to work in the United States.

Indians, and especially women, were the biggest beneficiaries of this rule, which was challenged by many American workers and even endorsed by the Trump administration. They want to repeal this rule. A three-judge bench of the District Court of the District Court of Columbia Circuit remanded the case to the lower court and noted that for the district court for the first time, an in-depth study of the case was an opportunity to make a decision on the basis of merit. "We reserve the district court's grant of summary judgment and send our opinion to further proceedings pursuant to our opinion," the federal court said in an order sent by Save Jobs USA. Save Jobs US is an American workers' organization that lost jobs because of the Obama administration's policy allowing H-4 visa holders to work.

By allowing H-4 visa holders to work in the United States, the Immigrant Homeland Security Agency seeks a remedy for a specific amendment to the rule that would allow H-4B visas to abandon non-immigrants' right to live in the United States, as well as lead to a legal resident's status. Is, as a result, employing such workers in the US trade Reduces the anger, the court said.

The court noted that the government disclosed that Haven-B non-immigrants and their families often have to wait a long time to obtain permanent resident status. Also, due to the H-4 visa holder's immediate opportunity to work these days, they face financial and personal difficulties which worsen the situation further.
