Court of Appeal today to review the order of 2018 on SC-ST Act

Unexpected even after 70 years of country's independence: Supreme Court

(PTI) New Delhi, Ta. September 30, 2019, Monday

The Supreme Court will give a verdict tomorrow on the Central Government's request for review on the 2018 ruling that the provision for arrest under the SC-ST Act was almost abolished. Arun Mishra, MR. A three-judge bench of Shah and BR Gwai will decide.

On September 18, the apex court had sharply criticized the two-judge bench's March 20 ruling last year. He observed that any ruling against the Constitution could be given?

Rather than pointing out that certain provisions can be issued to bring equality as per the provisions of the law, the apex court has said that even after 70 years of independence, discrimination and untouchability are maintained among the Scheduled Castes and Tribes.

Taking into account the situation of the removal of dirt from the head and the deaths of SC and ST people involved in such work, the apex court said that no one anywhere in the world was pushed into the gas chambers to die.

This happens only in India. 'This is totally against the Constitution. Is the law abusive only because a ruling against the Constitution can be given? Can you doubt it based solely on one's race?

Even the general category of persons can file a false FIR, ”the bench said. Senior advocate KK Venugopal, who appeared on behalf of the Center, told the Supreme Court that it had been 70 years since independence. Yet the government has not been able to provide security to the people of SC and ST society and they are always discriminated against.

The bench also took a critical view of the 2018 judgment figures. On the basis of this, a bench of two judges ordered whether the allegations made were subject to education under the SC-ST Act? It should be investigated by any officer lower than the DSP to find out. They also examine whether the allegations made were false or intimidating.
