Speculation is ready to abolish Article 35-A in Kashmir

New delhi date. 27 July 2019, Saturday

After suddenly deploying more than 3,000 troops in Jammu and Kashmir, it was speculated that the plan for eliminating Article 2 was ready. The government has planned in advance to maintain law and order in the state.

National Security Advisor Ajit Doval visited Jammu and Kashmir for two days. On reaching Ajit Doval capital, the central government announced the decision to deploy 6 more companies in Jammu and Kashmir. There was speculation that action was being taken in Jammu and Kashmir to remove Article 1A.

Demands were lifted across the country for the removal of Articles 3 and 3. The BJP had said in both Manifesto 1 and 2 that Articles 1-A and 3 would be canceled if there was a BJP government at the Center. During the first term, this direction did not work, but in the beginning of the second term, there is frequent demand for voting in Article-A in Parliament-Rajya Sabha. Home Minister Amit Shah also made an important statement on the issue.

Then the speculation has intensified that the government is going to make a decision on the issue. If Article 2A is abolished, it may be opposed in Kashmir. Organizations like the PDP, the National Conference to the Jammu and Kashmir People's Movement, etc. are also opposed to deleting Articles 3A and 3. Local leaders have called this arrangement as essential to the privilege of the citizens of Kashmir.

Meanwhile, Kashmir leaders started protesting with the government deploying 3,000 troops. After the Mehbooba Mufti protested, Shah Faizal claimed on Twitter that the government had increased the number of people leaving the Kashmir clause to remove the privilege clause. National Conference Leader Omar Abdullah also tweeted, requesting the government a few days ago that the Central Government should not take any decision till the petition is pending in the court on Articles 3-A and 3.

The government has not officially made any such announcement, but reports citing sources claimed that the government was planning to bring special bills to the Parliament and the Rajya Sabha and in view of this, there was a pre-planned move to curb the law and order situation in Jammu and Kashmir. It was also claimed to have named this operation.

What will be the difference if 1, 2 is removed from Kashmir?
The law has been amended about six times. There is also a fight in court over the issue between the Kashmir state government and the central government. If this law is changed or repealed, any citizen of India can remain in Kashmir. Get a government job in Kashmir and buy property in the state.

Investors in other states invest in Jammu and Kashmir so employment will also increase. If that happens, separatists in Kashmir will be lessened. Separatists cannot intimidate local citizens. If local youths get employment instead of terrorism, then there can be lasting peace in Kashmir within a decade.

What is Article 2?
This article was added by the President's order in the 5th. Under Article 2A, the Legislative Assembly of Jammu and Kashmir has the right to define the definition of permanent resident of the state. According to this provision of law, the citizens of Jammu and Kashmir have the privilege.

This privilege is granted on the basis of the notification of King Harisinh of Jammu and Kashmir. In 1 and 2, Harisinha made a rule for the privilege of the people of Kashmir and also made rules for tourists. Accordingly, no tourist outside Jammu and Kashmir can buy land or get permanent residence in the state.

After independence and after Kashmir was annexed to India, Sheikh Abdullah joined Article 5 while taking office. According to this law, the Parliament of India can only make laws of defense, foreign diplomacy and communication ie communication in Jammu and Kashmir. Any law other than that has to be approved by the Parliament.

Citizens other than Jammu and Kashmir cannot get government jobs, get scholarships and remain permanently in Jammu and Kashmir.
