Sexual assault by a husband without the wife's consent should be considered rape

The Karnataka High Court has sternly remarked on marital rape, saying that marriage is not a license for cruelty. The High Court in its order said that in our opinion, institution like marriage does not give privilege to any man in the society. Marriage also does not give a woman the right to be treated like animals. If this matter is punishable for a man then it should be punishable for a woman's husband also.

The Karnataka High Court in its landmark judgment has allowed rape charges against a man accused of forcing his wife to become a sex slave.

The order states that the argument that the husband is protected by an institution such as marriage for any of his work shall not be construed as granting any special man a privilege or license to release a cruel animal.

This type of sexual assault on the wife by the husband will have serious consequences. These types of attacks have psychological and physical effects. Such actions of the husband create fear in the wife.

The court ruled that sexual assault by a husband without the wife's consent must be treated as rape. It is worth mentioning that forcible sexual intercourse without the consent of the wife is known as marital rape.

Marital rape is considered a form of domestic violence against a wife. Even after years of campaigning, there is no marital rape criminal affairs in India.
