Spouse of H-1B visa holder will get automatic job approval

Spouses of professionals working in the United States on H-1B visas may now be able to find work in the United States. The Biden government is working to allow automatic employment to the spouses of H-1B visa holders. The Biden government's move will benefit Indian professionals the most. The US H-1B visa is one of the most popular among Indian professionals. Biden's move will benefit thousands of Indian-American women.
The US government has taken this decision following a legal action. The American Immigration Lawyers Association (AILA) filed a lawsuit this summer on behalf of the traveler's spouse. The facility will be offered by the US Citizenship and Immigration Services to the next of kin of H-1B visa holders (i.e. spouses or children under the age of 21). He previously had to obtain an H-4 visa to get a job. These visas are issued to people who have begun the process for legal employment-based PR status in the United States.
The case was filed this summer with the American Immigration Lawyers Association on behalf of immigrants' spouses. The Department of Homeland Security then agreed to issue a work permit to the spouses of H-1B visa holders. An agreement was reached against the Department of Homeland Security in a class-action suit filed by 12 plaintiffs (mostly Indian spouses). According to the agreement, those who are employed in the United States on an intra-company transfer will no longer have to apply for a work authorization to work in the United States.
In his application, Aila's Zone Vasden said that H-2B visa holders are people who always have to go through a regulatory examination to automatically extend the employment consent documents. The H-1B visa is a nonimmigrant visa, which allows American companies to meet the needs of foreign workers with theoretical or technical expertise. American companies recruit thousands of professionals each year from countries like India and China through H-1B visas.
H-2 visas are issued to people who are relatives and live in the United States with H-1B visa holders. However, according to the new decision, the previous stay on H-4 legislators under the policies of American Citizenship and Immigration Services will no longer apply.
The Aila called the Biden administration's decision a "major achievement" and said the Obama administration had allowed the spouses of some special H-1B visa holders to work. Since her ruling, more than 60,000 H-2B visa holders have been allowed to work less, most of them Indian-American women.
