Mumbai: The Bombay High Court has granted bail to Shah Rukh Khan's son Aryan Khan and co-accused Arbaaz Merchant and Moonmoon Dhamecha after 25 days in jail in a cruise ship drug party case.

After arguments in the Bombay High Court for the past two days, the court finally granted bail after concluding the hearing today. Details of the verdict will be known tomorrow and Aryan and the other two accused will have to spend another night in jail and will be released tomorrow or Saturday after their bail process is completed.

During the hearing, Additional Solicitor General Anil Singh, counsel for the Narcotics Control Bureau (NCB) in the High Court, said that petitioner Aryan Khan was not a novice customer but a regular drug user for the last two years.

A drug has been found under his report from a friend of Aryan. This is a case in which a person has not consumed drugs but can be booked under the NDPS Act if they are seized from him. The item was found from accused Aryan, Singh argued.

Aryal was represented by senior advocate Mukul Rohatgi as well as Satish Manshinde and Amit Desai. It was earlier argued on behalf of Aryan that the NCB was associating all the accused with all the seizures by abusing the conspiracy clause. The conspiracy clause was not applied when Aryan was arrested.

No drugs were found from Aryan and his WhatsApp chat had nothing to do with the case. Prior notice should have been given which did not happen in this case. Hence this arrest is illegal. Avidilil was also made. Single Judge Justice. Nitin W. Sambare granted the petitions of both the parties.

A detailed order will be issued by tomorrow evening, he said, adding that bail was granted. Aryan's lawyers therefore sought permission to post bail in cash which the court denied and said that security would have to be given. I could have ordered it tomorrow, but I gave it today. Attempts will be made to complete the bail proceedings of Aryan, who is currently in judicial custody and lodged in Arthur Road Jail, on Wednesday.

Aryan was arrested on October 3, 2021. Her friend Arbaaz Merchant (26) and fashion model Moonmoon Dhamecha (28) were also arrested. Dhamecha Byculla woman is in jail. The special NDPS court had appealed to the High Court against the order denying bail to the three.
