Live-in relationship between a man and a married woman is illegal

Jaipur, 17 August 2021 Tuesday

The Rajasthan High Court has ruled that a live-in relationship between a man and a married woman is illegal.

A single judge bench of Justice Satish Kumar Sharma also rejected the plea of the petitioners to provide police protection on the issue. The petitioners had submitted to the court that there was a risk of death to them in respect of the threats made to them by the defendants.

During the hearing of a joint petition filed by a married woman (30) and a man (27) living in Jhunjhunu district of Rajasthan, her lawyer said that both the applicants are adults and have consensually entered into a live-in relationship.

The couple is married, but has been forced to separate due to physical harassment by her husband.

Defendant's husband and her family's lawyer told the court that the relationship between the two applicants was illegal, anti-social and even illegal. They do not deserve protection.

Justice Satish Kumar Sharma said that after examining all the documents submitted by both the parties, it became clear that the female applicant was married and yet remained in a live-in relationship with the male applicant without divorcing her husband. This type of live-in relationship falls into the category of illicit relationships. The order is gone. Given on 15th August.
