New Delhi: The telecom department is all set to crack down on alleged commercial mobile SMS being sent with a bogus and fraudulent spirit. The telecom department will now permanently disconnect all telecom resources that send commercial SMS deceptively to customers by sending bogus SMS with fake headings and will impose a fine of up to Rs 10,000 for violating the rules.

Telemarketing companies will be most affected by the decision of the telecom department. There will now be a fine of Rs 1,000 for 10 unwanted SMS and Rs 5,000 for more than 10 unsolicited SMS and Rs 10,000 for sending more than 50 SMS. If the same mistake is made again and again, the telemarketing company will be fined and their mobile connection will be disconnected forever.

According to a notice issued by the telecom department on Monday, any sender (SMS sender) who is caught sending an SMS using an invalid header will be fined Rs 1,000 to Rs 10,000 for each violation as well as the ID or mobile number of the SMS sender forever depending on the number of violations. Will be closed.

The Department of Telecom said it will set up a Data Intelligence Unit (DIU) at the central level and Telecom Analytics for Fraud Management and Consumer Protection (TAFCOP) at the department's service area field unit.

Both the units will use the telecom service to get information on fraud, monitor user complaints, identify fake SIM cards obtained from fake ID proofs and mobile number portability fraud etc. and ensure timely resolution of all customer complaints along with various government departments.

The platform will be made available to law enforcement agencies, financial institutions, telecom service providers for seamless coordination in cases of fraud involving misuse of telecom resources, the notice said. Both platforms will collect data from all telecom customers of all service providers from all licensed service areas and detect suspicious connections or activity patterns.

Guided algorithms and data analytics will be used to identify all SIM cards issued by bogus documents for the purpose of making the database of telecom customers solid and accurate.

A web-based system and a mobile app to provide users with a platform to register their complaints about unofficial connections will also be made Safe Access of Telecom Resource Without Harassment and Infringement (partner).
