Kerala woman joins ISIS, jailed in Afghanistan from 2019, mother pleads for repatriation

A resident of Thiruvananthapuram K. Bindu has filed an application in the Kerala High Court seeking repatriation of his daughter Nimisha Fatima and her 4-year-old son. Nimisha was leaving Kerala to join the terrorist organization ISIS.

The habeas corpus petition seeks that the court direct the central government to bring Nimisha back to India. Nimisha is currently being held in an Afghan jail and has been asked to appear in court. That. Bindu has written in the application that he can take care of Nimisha's child. Nimisha and her son have been imprisoned in Afghanistan since 2019.

Measures not taken by the Central Government

In the petition, Bindu alleges that no proper steps have been taken by the Center so far to bring Nimisha and her son back to India. The petition argues that the failure to bring back Indian nationals, including children, is contrary to moral and legal obligations and the terms of an international agreement.

Indian security agencies have strongly opposed the return of Sonia Sebastian, Marin Jacob, Nimisha Fatima and Rafila and their children from prisons in Afghanistan. There is much skepticism on this point. The central government has not yet announced a political decision on the matter. None of the opposition forces has made its position clear.

In the year 2016-17, 4 Malayali women left the country to join ISIS. They first reached Iran and then Afghanistan. The husbands of the four women were killed in a US raid on an ISIS base and 408 people, including women and children, have since surrendered to the Afghan government.

In the year 2019, these 4 Malayali women, including ISIS activists, also surrendered. Afghanistan then asked the Indian government to repatriate the women.
