Important Supreme Court decision: Declares Maratha reservation in education and jobs unconstitutional


- Court rules no newcomer can be given a job or a seat in a college on the basis of Maratha reservation

The Supreme Court on Wednesday delivered a landmark judgment on the Maratha reservation. The Supreme Court has declared the Maratha reservation unconstitutional in the field of education and employment. According to the court's ruling, no new person can be given a job or a seat in a college on the basis of Maratha reservation.

The Supreme Court said that the Maratha community cannot be declared socially, educationally backward for the quota, it violates the right to equality in the Maharashtra State Act of 2018. The court said it would not reconsider the 1992 decision, which suspended the reservation quota to 50 per cent.

The decision has been pronounced by a five-judge bench of the Supreme Court. According to the Supreme Court, the Maratha reservation is a violation of the 50 per cent limit. Following this judgment of the court, there will be no change in the PG medical course which has already been enrolled, no change will be made in all the previous appointments. This means that previous patterns and appointments will not be affected.

5 judges gave 3 different judgments but all of them considered that reservation cannot be given to Maratha community, reservation cannot be more than 50%, reservation can be given only to backward class, Marathas do not fall in this category, reservation was given by state government under emergency clause. But there was no emergency here.

What is the math of reservation

If we get the reservation given to various communities and economically weaker people, then about 75 per cent reservation has been made in Maharashtra. After the State Reservation Act of 2001, the total reservation in Maharashtra was 52%. The state's total reservation was 64-65 per cent with a 12-13 per cent Maratha quota. The 10 per cent quota for the economically weaker section (EWS) announced by the Center in the state is also effective.
