We are also responsible for increasing the case load: Supreme Court Judge

New Delhi, Saturday 27 February 2021

The apex court believes that we ourselves are to some extent responsible for increasing the case load, the court said that while we allow a party to give written assurances, in most cases a contempt petition is then filed, thus hundreds against us. Disrespect petitions are pending petitions are pending, a bench of Justice Chandrachud said, adding that in fact we are extending the case in the Supreme Court.

A bench of Justices Chandrachud and MR Shah was considering a special permission petition against the order of the Karnataka High Court, in which an amendment petition was filed against the eviction order, followed by a reconsideration petition on the judgment Accepted the special request to give extra time to do, but in this case time was sought to vacate by re-filing the application.

"Sometimes we extend the time to vacate by six months or one year, but such cases are pending in the lower court for 15 years and up to two decades, and now why should we extend this time," the bench said. The bench said that where a party gives written assurance to vacate the premises within a special period in compliance with the court order.

While the other party is compelled to file a contempt petition in the court again if it is violated in most of the cases, Justice Shah agreed and said that we are responsible for increasing the burden of the Supreme Court, which was later rejected by the court.
