If the husband's salary increases, the wife is also entitled to the increased interim maintenance allowance

In a marriage dispute case, the Panchkula Family Court ruled that the interim alimony allowance for a wife should be increased from Rs 20,000 to Rs 28,000 and the High Court refused to intervene. The High Court rejected the husband's application, saying that if the husband's salary was increased, the wife was also entitled to the increased interim alimony allowance.

Panchkula resident Varun Jagotta had filed an application in the High Court challenging the Panchkula Family Court's five-way 2020 judgment. The petitioner said that the Family Court in its judgment said that the salary of the petitioner has been increased from Rs 95,000 to Rs 114,000 which is not appropriate. After all deductions, he gets a salary of Rs 92,175 and how can he be ordered to pay an interim maintenance allowance of Rs 28,000.

Dismissing the argument, the court said that the possibility of High Court intervention in the revision petition is very low. This happens when the order is against the law or biased. There seems to be nothing like that in this case.

On the other hand, where the husband's salary has gone up, the wife's house rent has also gone up by Rs 1,500. The Family Court, while hearing its judgment, said that all the facts have been considered and the order has been elaborated. The High Court has quashed his plea, refusing to grant any relief in the matter.
