The history of human rights is very ancient, but the first declaration of human rights in the modern world was made by the National Assembly of France in 1918. The issue of fundamental rights has become very important since the French National Assembly declared human rights. The constitutional bodies of many countries have considered fundamental rights important in their constitutions. The Constitution of the United States of America is one of the oldest constitutions in the world.

The Constitution of the United States is the first written constitution in the world. In which civil rights are clearly stated. The Sapru Committee was opposed to partition. The Constitution of India also gives fundamental rights to citizens. In India, Bal Gangadhar Tilak was the first to speak about the fundamental rights of the citizens. After that, the demand for fundamental rights continued to rise in the freedom movement. Fundamental issues such as the right to freedom of expression and equality of law were raised. In 1917, the Nehru Committee demanded fundamental rights for Indians.

The issue of fundamental rights was raised loudly in the 19th Congress session in Karachi and in the 19th Sapru Committee. However, before the independence of India, the fundamental rights of the citizens of the country were not given. The Constitution enacted in the country on January 3, 1907 gave seven fundamental rights to the citizens of India. However, the 8th amendment to the constitution removed the right to property from the list of fundamental rights.
