JNU student Dewang's Kalita granted bail, made inflammatory speeches in Delhi riots

Dewang's Kalita, a JNU student who made inflammatory speeches on new citizenship laws and the issue of citizens' registers during the violent riots in Delhi in February this year, was granted bail. However, despite being granted bail, he will not be released from jail as he was arrested under the Unlawful Activities Prevention Act.

According to the police indictment, Dewangana made a provocative speech against the new law on citizenship near Jafrabad metro railway station. The Delhi High Court had said that there was nothing provocative in Dewangana's speech and that he could be released on bail. The High Court further said that Dewangana had taken part in peaceful demonstrations rather than enjoying the fundamental rights under Article 19 of the Constitution.

The High Court had ordered him to be released on a bond of Rs 25,000 and to pay the bail amount. However, he could not be released as he was arrested under UAPA. The High Court made it clear that he would not leave the country and warned against directly or indirectly influencing witnesses. Justice Suresh Kumar Jain said, "I am of the view that granting bail to the petitioner will not hamper the investigation into the riots in Delhi." Bail will free him from unnecessary torture, mental anguish and detention. Last week, a lower court rejected Dewangana's bail application.

The High Court said in no uncertain terms that there was nothing in Dewangana's speech to provoke women of a particular society. Police have not been able to provide any evidence that the speech sparked violent riots.
