'National Conference leaders not in detention', state government's submission in Jammu and Kashmir High Court

The Jammu and Kashmir administration had told the Jammu and Kashmir High Court that no leader or activist of the National Conference had been detained. National Conference President Dr Farooq Abdullah and Vice President Omar Abdullah had filed a habeas corpus petition in the High Court ordering the release of some of our leaders and activists who have been detained.

Against this, the state government had submitted that some people are allowed to move with certain restrictions in view of their safety. No one was detained. Additional Solicitor General Bashir Ahmed Dare, on behalf of the state government, told the court that no legal action had been taken against anyone and no thought had been given in that direction. The petition is an attempt to increase unnecessary tension and put undue pressure on the administration.

The Jammu and Kashmir police chief had earlier told the high court that following some changes in the constitutional provision last year, the police and the state government suspected that some haters would try to provoke the local people in a way that endangered law and order. That is why action was forced against some people. The police chief also said that no section of the law has been applied against any leader or activist and they have not been detained. Some restrictions were imposed on them only for their safety.

Dr. Farooq Abdullah had on August 11 filed an application in the Jammu and Kashmir High Court that at least 16 leaders of my party have been detained without cause. The court ordered his immediate release. In response, the state administration clarified this.
