New delhi date. Tuesday, August 25, 2020

Prominent Supreme Court lawyer Prashant Bhushan is facing a contempt of court case. He was convicted in the case while the court on Tuesday reserved judgment on the sentence. On the other hand, there were arguments between Prashant Bhushan's lawyer, the Attorney General and the judge. Bhushan's lawyer said he did not commit any theft or murder and that he was being punished for such a simple tweet.

Prashant Bhushan, on the other hand, told the Supreme Court for the second time that he would not apologize for his statement and that whatever he said was not contempt of court. However, Bhushan has asked the court to reconsider its decision to convict him. On the other hand, the court has also told Prashant Bhushan that if you hurt someone, then what is the problem in apologizing?

On behalf of the government, Attorney General KK Venugopal said that Prashant Bhushan should be reprimanded by the Supreme Court and let go. While Prashant Bhushan's lawyer also said that if Prashant Bhushan was sentenced, he would be considered great in the eyes of the people and the Supreme Court should not allow him to become a martyr. At the same time the court should show statesmanship or generosity. And they should be let go without any punishment.

The Supreme Court, after hearing the arguments, said that when you hurt someone, you should also apologize to them. Prashant Bhushan himself is justifying what he tweeted which is sad to know.

Such an answer was not expected from a lawyer like Prashant Bhushan with 30 years of experience and this is not just a case of Prashant Bhushan, contempt of court and such an answer is now becoming commonplace. On behalf of Prashant Bhushan, Rajiv Dhawan, a well-known lawyer, argued that "we propose to the court that the court should reverse the conviction."

At the same time, Prashant Bhushan also said that if I apologized to the Supreme Court, my distance would be an insult to the soul, the Supreme Court should also tolerate criticism. While Venugopal said that whatever arguments or statements made by Prashant Bhushan should be withdrawn and at the same time regret should be expressed before the court. While the Supreme Court should pardon Prashant Bhushan.

Bhushan's 2009 contempt of court case will be referred to another bench

Prashant Bhushan had earlier filed a contempt of court case in 2009. The court also sent a notice to Bhushan in the matter. Journalist Tarun Tejpal has also been charged in the case. Now the Supreme Court has decided to refer the case to another bench. So now Prashant Bhushan can be prosecuted in not one but two different cases. Prashant Bhushan, in an interview with a magazine at the time, accused the Supreme Court sitting and other judges of corruption. Tarun Tejpal was the editor of this magazine at that time. While the arguments of the present case were going on, the court said that this is not just the case of Prashant Bhushan, this is a huge case. Many contempt of court petitions are pending and such contempt is now becoming commonplace.

Don't assume we're not tolerating criticism: Supreme

Supreme Court Judge Arun Mishra: We have given Prashant Bhushan so much time to apologize but he is not ready to believe, he says I have not done any contempt but he has clearly said that the Supreme Court has been destroyed, isn't this an offensive statement? Don't think that we are not tolerating criticism. There are many contempt petitions pending in the court, have we punished anyone? What's wrong with apologizing? Is the word apology bad? Judges cannot defend themselves, judges are not different from lawyers so everyone should respect each other. It is the responsibility of the Attorney General to protect this judiciary.
