After a lengthy legal process, a petitioner had approached the Supreme Court over the delay in the execution of convicts sentenced to death. The apex court, while hearing the petition, said that the apex court could not order the president to dispose of the petition sooner.

The apex court also said that it could now be decided that the home ministry should send a mercy petition to the president within a specified time. The apex court later sought a reply from the central government on the whole matter.

The perpetrators of Nirbhaya tried to escape the death penalty by making various petitions.
