Bombay High Court: Not traitors or traitors opposed to CAA-NRC

The Aurangabad bench of the Mumbai High Court has expressed a clear view that if a movement is protested in a peaceful way in opposition to the law, it cannot be considered a traitor or a traitor.

The bench, hearing the petition filed in the court protesting that the anti-CA movement was not allowed by the police, has expressed this view. Zakhi Sheikh sought clearance for a peaceful protest against the CAA and the NRC. His plan was to stage this agitation in the old Eidgah grounds of Majalgaon.

But the reason for law and order was not granted by the Additional District Magistrate of Beed district. On the basis of this, the police in Majalgaon city refused permission. The Sheikh, after throwing himself in the High Court, rejected the order of the magistrate and the police.

'Opposing just one law does not constitute a traitor or a patriot. The question of no violation of any provision of law due to performance does not arise. The court must consider the demand for peaceful agitation. '

The Bombay High Court bench, while denouncing Sue, said that opposition to the citizenship law was just a protest against the government. When we consider such an action, we must be aware that we are a democratic country and our Constitution has given us the rule of law, not the rule of the majority.

When such legislation is made, some people, especially Muslims, may feel that this is against their interests. Therefore, such a law can be opposed. This is a matter of their assumptions and beliefs and the court cannot go into their assumptions or marks of trust.
