CAA's refusal to apply is unconstitutional: Kapil Sibal

On the one hand, the state government is refusing to apply the CAA. Congress leader Kapil Sibal, on the other hand, said that because the CAA is a law passed by Parliament, state governments must enforce it and it cannot be denied.

Siebel claims that the CAA's refusal to apply is unconstitutional, and no state can refuse to enforce it. Sibal also targeted the Kerala Governor and Prime Minister Narendra Modi.

Sibal said the Kerala governor had no knowledge of the constitution. He spoke this Saturday at the Literature Festival in Kerala. Sibal went on to say that if the CAA passes, no state can say that we cannot enforce it.

The Constitution does not allow this and since the CAA has passed in Parliament, it is the duty of the state governments to implement it. At the same time, he said that if any state wants, it can pass a proposal in the legislature against this law and tell the government that it should repeal the law.
