Supreme agree to reconsider decision to exclude SC-ST creamy layer from reserve

The SC-ST's decision to exclude the creamy layer from the reserve was made in 2018 by a bench of five Supreme Court judges. The central government has submitted to the Supreme Court to reconsider that decision. The Supreme Court will hear the petition two weeks later.

In the apex court, the central government applied for a reconsideration of the 2018 verdict. In 2018, a bench of five judges said that the creamy layer of SC and ST could not get the benefit of reservation in college and government jobs. In a nutshell, the Supreme Court directed that the rich people of SC and ST have to issue a non-creamy layer certificate.

The central government has submitted to the Supreme Court to reconsider that directive. The central government, appealing in favor of the reservation, said that this was an emotional issue and it was necessary to re-examine the decision to keep the creamy layer away from the reserve.

The central government told the Supreme Court that the decision to keep the creamy layer out of reserve was not appropriate. During the hearing, the Supreme Court said that a hearing will be held in this regard after two weeks.

Samata agitation committee and former IAS officer OP Shukla had made a fresh application on the issue. The new petition calls for a rational process for the identification of the creamy layer of SC-ST. The Supreme Court had requested that the cream layer be separated from the non creamy layer.
