Nirbhaya case convicts jailed in Tihar Jail

Supreme Court rejects plea of three convicts in July 2018

(PTI) New Delhi, Ta. December 10, 2019, Tuesday

In December 2012, all the culprits of the Nirbhaya gang rape and murder case have been collected in Tihar Jail. One of the culprits of the case has been shifted from Mandoli jail to Tihar Jail, jail authorities said on Tuesday. As a result, the possibility of hanging the perpetrators of Nirbhaya case at any time has been strong.

After the events of the burning of rape victims in Hyderabad and Unnao, the question of why Nirbhaya convicts were not hanged all over the country began to raise even after seven years.

Director General of the Jail Department Sandeep Goyal said that Pawan Kumar Gupta, imprisoned in Mandoli jail, was recently released in Tihar jail. Gupta has been kept in Tihar Jail No.2 while the other two convicts Mukesh Singh and Akshay are in the same jail while Vinay Sharma has been imprisoned in Tihar Jail No-4, another jail official said.

Meanwhile, Akshay, one of the four convicts, filed a review petition in the Supreme Court on Tuesday against his 2017 death sentence. On July 9, 2018, the Supreme Court rejected the review petition filed by three other convicts, Mukesh (30), Pawan Gupta (23) and Vinay Sharma (24).

Akshay did not file a re-review application at this time. The Supreme Court upheld the death sentence of the High Court and the trial court in its ruling in 2017. All four accused have fallen asleep after hearing the news of the execution.

Akshay has now filed a re-review petition as his lawyer AP Singh said. In Akshay's re-review petition, the Supreme Court has questioned why the death sentence is given when human life is getting shorter and shorter. In the petition, he has quoted the sources of the Vedas, Puranas and Upanishads and argued that in Satyuga, man's life was very long. But now the human life span is reduced.

Akshay also raised the issue of Delhi's water and air pollution in the petition. He has questioned, everyone knows that people are dying from air and water pollution in Delhi NCR so why are they being hanged? By allowing the death penalty, the government allows the pre-determined and cold college murder of a man in the name of justice.

Sixteen men, including a bus driver, conductors and helpers, were brutally raped by a 23-year-old physiotherapy intern on December 16, 2012 in a bus in south Delhi.

Nirbhaya was shifted to Mount Elizabeth Hospital in Singapore after being treated for several days in New Delhi, where he died on December 29, 2012 due to injuries.

All the culprits, including minors, were arrested within a few days in this case and were charged with rape and murder. One of the convicted Ram Singh was killed in police custody.

A minor accused of rape and murder was sentenced to three years in prison at the Child Correctional Center. The remaining four adult accused were sentenced to death on September 10, 2013, guilty of rape and murder. The Delhi High Court upheld the lower court's ruling on March 13, 2014.
