Question - What is a Detention Center?

Answer: A detention center is called a detention center where a citizen of another country illegally detained is detained. He is kept in a detention center until he can prove his citizenship in the country he came from.

If a tribunal or court declares it to be foreign and declares it to be illegal in the country concerned, it is repatriated to the country from which it came. Foreign citizens who violate the Foreigners Act and Passport Act are kept in detention centers until they are repatriated to their country. It also means that if the foreigner is allowed to stay longer in the country than if he / she has been granted visa to stay, he can be sent to the detention center.

Under Section 3 (2) C of the Foreigners Act 1946, the Government of India has the right to expel the illegal living in the country. According to the Passport Act of 1920, the Government of India has the legal right to expel a person who does not have a valid passport or other legal documents under sections 239 and 258 (1) of the Constitution.

Question: Where and how many Detention Centers are there in India?

Answer: In 2012, the then Congress government created such detention centers in Assam. Earlier, such detention centers were established in the district jails of Golpada, Kokrajhar and Silchar. Subsequently, such centers were set up in the district jails of Tejpur, Dibrugarh and Jorhat. These centers have the capacity to accommodate 1,000 people, but more than capacity has been detained.

The Central Government empowered States to constitute such Detention Centers under provision 3 (2) of the Foreigners Act, 1946 and paragraph 11 (2) of the Foreigners Order 1948. Accordingly, such centers were created by the states.

Question: Why is there so much on the issue of Detention Center?

Answer: When it came to the implementation of the National Register of Citizens in the country, the first issue was yes. As many as 19 lakh people were found illegally applying NRC with the permission of the Supreme Court in Assam. If they cannot prove that they are Indian citizens, they will be forced to go out of the country.

Question: Are new detention centers being established in the country right now?

Answer: Yes. Currently, a new Detention Center is being set up at Golpada in Assam and the Central Government has provided the details of what the new ideal Detention Centers should be. Accordingly, new centers will be set up.
