The applicant withdrew the application, but the court filed a suitomoto

New delhi date. November 26, 2019, Tuesday

For the first time in the history of Pakistan, the Supreme Court has suspended a notification to extend the tenure of Pakistan Army Chief General Qamar Javed. Although the order was provisional, the case will be heard again on Wednesday.

The order was issued a few days before his retirement on November 29. Earlier in August, Prime Minister Imran Khan approved a three-year extension to serve as general.

The proposal issued by the office of Prime Minister Imran Khan has been approved by General Qamar Bajwa to remain in the post of Pak army chief for three more years from the date of completion of his current term.

Chief Justice Asif Saeed Khosa said that only the president can extend the tenure of the army chief. After the government's notification was suspended, the court held the next hearing on tomorrow.

The court also sent notices to the defense ministry, the central government and Bajwa. Attorney General Anwar Mansour opposed the Chief Justice's observation, saying that the announcement was made only after the president's consent. However, the Chief Justice suspended the extension notification and held a hearing tomorrow, Wednesday for further proceedings.

He also noted that when the matter was discussed in the Cabinet, only eleven out of the 25 seem to have approved it. Does the Cabinet not even give its members time to think?

The 14 members of the cabinet have not yet given an extension to Bajwa, ”the judge said. A person named Riaz Rahi filed an application against the extension, however, he later withdrew the application.

But Xhosa rejected the withdrawal of the application and considered it a public interest application under section 184. If the apex court rejects the application for dismissal, Bajwa will have to resign on Thursday.
