The possibility of judgment today on whether the CJI office falls within the purview of the RTI

New delhi date. November 12, 2019, Tuesday

There may be a verdict tomorrow as to whether the office of the Chief Justice of the Supreme Court should fall within the purview of the RTI. The Constitutional Bench reserved the decision after hearing the case in April.

One of the biggest arguments in bringing the judges' work to the forefront of the RTI is that it will increase credibility for the judiciary in the people and provide greater transparency in the system.

The Delhi High Court's order of the Supreme Court Registrar has challenged the order in which the CIC order was upheld. In its order, the CIC said that the office of the Chief Justice of the Supreme Court is within the purview of the RTI.

The CIC and the High Court order were challenged by the Supreme Court Registrar in 2010. At that time, the Supreme Court stayed the order of the High Court and submitted the case to the Constitutional Bench.

In this case, senior lawyer Prashant Bhushan argued that the function of the judges falls under the purview of the right to information. The senior advocate further said that information should be made public despite the fact that other colleges of the college, including the Chief Justice, are doing well.

Hearing the case, the Chief Justice said no one wants the system to be opaque. Nobody wants to work in the dark and nobody wants to be in the dark. Currently, a verdict on this has been reserved.
